Haynes <br /> Present: Sheila De Forest, Chuck Kincaid, Kevin D. Leavy, David F. Luebke, and Mark Spreitzer <br /> Absent: James E. Van De Bogart <br /> 1. The meeting was called to order at 7:00 p.m. in the Forum at Beloit City Hall. <br /> 2. PLEDGE OF ALLEGIANCE <br /> 3. SPECIAL ORDERS OF THE DAY/ANNOUNCEMENTS <br /> a. Public Works Operations Director Christine Walsh and Jim Hessling, Director of Public Works for <br /> the Village of Cottage Grove and member of the Wisconsin American Public Works Association <br /> Executive Committee, presented the American Public Works Association— Professional <br /> Manager of the Year 2012—Emergency Management Award to Bruce Slagoski. Mr. Hessling <br /> commended Mr. Slagoski for integrating emergency management to all aspects of his job at the <br /> City of Beloit. Mr. Hessling said that Mr. Slagoski is a first responder for hazardous spills and <br /> contributed his knowledge and expertise to the state-wide incident command structure. Mr. <br /> Slagoski said that the award is a great honor and thanked the Council, the Manager, and the <br /> other City departments for allowing him to continue to do what he loves to do. <br /> 4. PUBLIC HEARINGS <br /> a. Community Development Director Julie Christensen presented a resolution authorizing a <br /> Conditional Use Permit to allow a Residential Care Apartment Complex in a C-1, Office District, <br /> for the property located at 2157 Schuster Drive. It was noted that the Plan Commission <br /> recommended approval 4-0. Ms. Christensen noted that this development will require a two-lot <br /> certified survey map because two buildings may not be constructed on one lot. She presented the <br /> conditions as recommended by staff and the Plan Commission. Councilor Haynes opened and <br /> closed the public hearing without participation. Councilor De Forest made a motion to adopt the <br /> resolution, and Councilor Leavy seconded. The motion carried 6-0. File 8543 <br /> b. Ms. Christensen presented a resolution authorizing a Conditional Use Permit to allow a drive-in <br /> use in a C-3, Community Commercial District, and to allow an automatic car wash bay to face <br /> and open toward Milwaukee Road in a MRO, Milwaukee Road Overlay District, for the property <br /> located at 2748 Milwaukee Road, doing business as Sponge Spa Car Wash. It was noted that the <br /> Plan Commission recommended approval 4-0. Councilor Haynes opened and closed the public <br /> hearing without participation. Councilor Leavy made a motion to adopt the resolution, and <br /> Councilor Luebke seconded. The motion carried 6-0. File 7724 <br /> c. Ms. Christensen presented a resolution authorizing an Exception to the Architectural Review <br /> and Landscape Code regarding the open green space requirement of Section 34.21(2)(b) of the <br /> City of Beloit Municipal Code, for the property located at 2557 Park Avenue, doing business as <br /> Snack City Vending. It was noted that the Plan Commission recommended denial 3-1. Councilor <br /> Haynes opened and closed the public hearing without participation. Councilor Spreitzer made a <br /> motion to adopt the resolution, and Councilor Kincaid seconded. Councilor De Forest said that <br /> the applicant indicated that he wanted to leave space in the rear of the building for expansion, <br /> which should be considered a hardship. Ms. Christensen said that the applicant measured his <br /> property line inaccurately at the beginning of this process and that he has the space to meet the <br /> landscape requirements of the code. Councilor Luebke indicated that the applicant is aware that <br /> he measured incorrectly and that there is an extra five feet of land to the rear of the property. <br /> Councilor Leavy said that the Council should not grant an exception without a real hardship. <br /> Councilor Haynes said that there are multiple reasons for open green space requirements <br /> including aesthetics, storm water collection, and rainfall absorption. He said it is wise to follow the <br /> letter and intent of the code unless there is a real hardship. De Forest asked that staff <br /> communicate to the applicant that, if there is a hardship for the business as they proceed with the <br />
