Ms. Christensen presented a resolution approving an Appeal of the Denial of a Certificate of <br /> Appropriateness and Granting a Certificate of Appropriateness for the property located at 748 <br /> Wisconsin Avenue. She explained the timeline and history of the property, indicating that three <br /> wood double-hung windows were replaced with a bay window without building permit or a <br /> Certificate of Appropriateness from the Landmarks Commission. She said a stop-work order was <br /> issued, work continued, and a citation was issued. She also said that a Certificate of Appropriate <br /> Application was denied by the Landmarks Commission. Landmarks Commission Chairman Rick <br /> McGrath discussed the decision to deny the Certificate of Appropriateness. Councilor Haynes <br /> opened the public hearing. Ron Kline, 748 Wisconsin Avenue, said that he appreciates the <br /> efforts of the Landmarks Commission to maintain historic properties. However, he indicated that <br /> his property was built in 1907 and does not look like any of the other houses in the historic <br /> district. He said the windows were inefficient, so he replaced them. He said that he does not feel <br /> like he did anything wrong. Councilor Haynes closed the public hearing. Councilor De Forest <br /> made a motion to adopt the resolution, and Councilor Spreitzer seconded. Councilor Haynes said <br /> that he is outraged that the applicant continued to work on the project without a Certificate of <br /> Appropriateness while a stop-work order had been issued. Councilor De Forest asked staff what <br /> the applicant would have to do if the Council denies the appeal, and Ms. Christensen said that the <br /> applicant would have to remove the bay window that was installed illegally after re-applying to the <br /> Landmarks Commission with a different replacement proposal. Councilor Spreitzer said that there <br /> is not any evidence that the Landmarks Commission made a bad or incorrect decision and that <br /> approving this appeal would send a bad message to the rest of the community. Councilor Haynes <br /> reminded the Council that the applicant's problem is entirely his own creation. Councilor Kincaid <br /> said that he hopes the applicant, staff, and the Landmarks Commission can come to a <br /> reasonable agreement and move forward. Councilor Haynes called the question, and the motion <br /> failed 1-5, with Councilor De Forest voting in favor of the appeal. File 8545 <br /> 5. CITIZENS' PARTICIPATION —none <br /> 6. CONSENT AGENDA <br /> Councilor Luebke made a motion to adopt the Consent Agenda, which consists of items 6.a. through <br /> 6.c. Councilor Leavy seconded, and the motion carried that the Consent Agenda be accepted, <br /> approved, adopted, or referred and acted upon as required by state and local codes by a vote of 6-0. <br /> a. The Minutes of the Regular Meeting of June 4, 2012 were approved. <br /> b. The resolution approving a Class "B" Beer and "Class C"Wine License for Little Mexico of <br /> Beloit, located at 2787 Milwaukee Road, Fernando Camarena, Agent, was adopted. File 8542 <br /> c. The resolution approving a renewal Class "A" Beer License for Beloit Citgo-Profuel Seven, <br /> located at 1888 Shopiere Road, Akbir Kang, Agent, was adopted. File 8542 <br /> 7. ORDINANCES— none <br /> 8. APPOINTMENTS <br /> Councilor Haynes announced openings and submitted the following appointments to the City <br /> Committees, Boards, and Commission for approval. The appointments were approved by a motion by <br /> Councilor Luebke and a second by Councilor Kincaid. The motion carried 5-0-1, with Councilor <br /> Spreitzer abstaining. <br /> a. Alcohol Beverage License Control Committee: Tina Goecks, School District of Beloit <br /> Representative, for the 2012-2013 school year; and Joseph Vickerman to a term ending June 30, <br /> 2015.
